In the event of a member of the public requiring information from George Municipality in terms of Section 18 of the Promotion of Access to Information Act, 2 of 2000, the following procedures should be followed:

  • The request must be made in writing on the prescribed form, see link above.
  • Submit the application form with supporting documentation to the Records Department of the George Municipality.
  • The applicant should provide sufficient particulars to enable the delegated official to identify the record(s) requested and the requester.
  • Where applicable the application form must be accompanied by the prescribed application fee (Registry official will advise).
  • The application should be accompanied by a certified copy of the requester’s identity document or passport.
  • If the requester is requesting the information on behalf of someone else or on behalf of a juristic person, a power of attorney will be required with the necessary supporting documentation.
  • Proof of ownership should the requester be requesting information in relation to specific immovable property.
  • Proof of payment of the application fee, if applicable.
  • In the event that all of the required information is received, the 30-day response period will commence, and the application will be submitted to the Information Officer or Deputy Information Officer, to assess whether the requested information can be released.
  • The requester will be provided with the requested records, if approved by the Information Officer and if such records are available to the Municipality, as soon as reasonably possible, but in any event within 30 days after receipt of the application form, the above requirements have been met and prescribed fee paid (where applicable).
  • If a request for access is made for information which George Municipality is not in possession or control of, or where the information is more closely connected to another public body’s function, the request will be transferred as soon as reasonably possible but in any event within 14 days after the request is received to the other body/ institution/ organization who could provide the information.
  • Where all reasonable steps have been taken to find a record requested, and reasonable grounds exist to believe that the record cannot be found or does not exist, the Information officer will provide an affidavit of affirmation, notifying the requester accordingly that access cannot be given.
  • In the event that the requester is requesting records that relate to a third party, the third party shall be notified of such request as soon as reasonably possible but in any event within 21 days from receiving the application, and will be provided with a timeframe of 21 days to make written or oral representations to the Municipal Information Officer on why the request for access should be refused or give written consent for the disclosure of the record to the requester.
  • The Information Officer shall as soon as reasonably possible, but in any event within 30 days after the third-party process is notified, decide on the request received.
